We are updating our Terms of Use to make them comply with the new European data protection regulation.

Coming from the corporate world, we have taken very seriously every user’s privacy since our inception. These changes better describe how you can manage your personal information and access this information on the site.

Introduction

The Terms of Use is the contract that binds you with Alta Data (the Editor) of The Official Board ® (the Service). By using this website (the Site) or the Mobile Application (the App), you (the User) acknowledge that you have read, understood and agree to be bound by these Terms of Use and to respect any laws related to them.

If you do not fully accept these Terms of Use, you cannot use the Service.

The Terms of Use may be amended from time to time without notice. It is your responsibility to check for any such revisions or updates. Your continued use after the effective change constitutes your acceptance of an agreement to such changes. The previous version will be kept for you on the Site as a reference.

 

Purpose of the Site and of the App

We (The Editor) are collecting and verifying publicly-available information (the Content) about the world's largest companies (Companies) and their main executives (Executives).

This Content is gathered from the Company websites, Company press releases, Company regulatory information and public filings and more generally from all the public communication posted by the companies and its key employees, believed by the Editor to be reliable.

The Content is shared as a service with its un-registered site visitors (Visitors), its registered site visitors (Members), its App users and the Company Executives collectively described as its users (Users).

 

License

The Editor grants you as a User a non-exclusive license of consultation of its Content for a personal, individual and internal use.

This license is not assignable or transferable. This license forbids you to reproduce all or part of the Content, to communicate, to distribute, and generally to provide third-party, content in any manner whatsoever, for free or otherwise. It prohibits you and others from any acts of resale, rental, loan or exchange and from any uses of robot, spider or automatic device to access or copy our database.

 

The Content

The listed Companies are large companies, the companies that have an annual turnover in excess of 100 million U.S. $. This information is likely to evolve in the future so as to be more current and reliably accurate as The Editor learns of necessary updates. For each company, the information (the Company Information) collected includes its name, its company websites, its phone numbers, its Twitter accounts, its mother company, its country of registration, and its industry.

For each company, the listed Executives are the most senior-level executives representing these Companies, comprising those executives being in the first three reporting levels: the Chief Executive Officer and the Board of Directors, the direct reports of the Chief Executive Officer, and their direct reports.

For each Executive, the information (the Executive Information) collected includes the first and last names, the business e-mail, the Twitter account, the business title, and the reporting line for these Executives.

The Company Information and the Executive Information can be supplemented beyond the current Information with information such as the history of their updates, their professional phone numbers or with additional business references collected from various public sources.

The Content exclusively consists of proven, verifiable public corporate information.

Each User can contribute to the accuracy and quality of the Content (Contribution). Each User can amend the Content. Each User promises to only provide truthful information that the User has the right to share publicly.

The Editor acts as a trusted party between its Users and maintains the confidentiality of the authors of the Contribution.

The Editor makes its best efforts to verify the accuracy of every Contribution by directly contacting the Companies and its Executives and by cross-checking these contributions with any other reliable public sources.

In cases where the Content cannot be reasonably verified by the Editor, the Content is not posted and is systematically deleted.

 

The rights and duties for the Site Visitors

For each Company, the Site provides free access to some Company Information and for some of its Executives access to some Executive Information.

A search engine allows access to all Companies, to sort them by industry or by country of registration.

The other services can only be used by the Members.

 

The rights and duties for the Site Members

A Member is an individual who has registered himself with his real name, a valid e-mail address and who has accepted the Site’s Terms of Use. It entitles him to an account opening access to the Services. Each person can have only one account. Each Member certifies to be a capable adult of 18 years of age or older.

This account allows searching and sorting the Companies and their Executives through several fields including name, title, industry, country, or the last update date.

Most of the information is free for the Members except some harder to obtain information which can only be seen by the principle (For one piece of information added to the community of Members, a User can view more than 10 pieces of information.

A rate of exchange is used to rule the exchange of information between a Member and the community of the Members. The currency of exchange among Members is called the Taler. The rate of exchange is available on the Site and is likely to be updated from time to time.

Each Member has an account detailing the available Service, the Talers he has earned and the Talers he has spent. The earned Talers cannot be sold, exchanged, or transferred. Each piece of information and its updates is available by the Member free of charge for one year. Each Taler is valid for three years after its date of acquisition.

The Editor will employ its best efforts to process any update by a Member on the Executive Information or the Company Information reported as inexact or outdated within 72 hours of notification. Each Member can close his account at any time. The closure will not entitle any Member to compensation or reimbursement of any sort. The Editor will employ its best efforts to close the account within 72 hours of receiving notification.

Each Member undertakes to make his best efforts to provide accurate and sincere information, and to immediately report information that appears to be inaccurate or not up to date. Each Member pledges to provide only information that he has the right to provide or that does not violate the intellectual property rights or the privacy of anyone.

Each Member undertakes to use the Site with professional responsibility, respecting the privacy and rights of everyone. Any Member who does not comply with the conditions and Terms of Use agrees to be immediately removed without compensation or reimbursement. A Member whose account has been suspended or closed is prohibited from opening another account.

Each account is personal and cannot be shared with anyone else. Each Member is responsible for maintaining the confidentiality of his password. In the event this password is lost or forgotten, the Member must immediately contact the Editor at [email protected].

 

Three levels of Service for Site Members

There are three levels of Services: NetWorker, Premium, and VIP. Each is detailed here.

The first level is the NetWorker Member. Access to this is free. It allows the Member to view, search, sort, and update Company and Executive Information, and to schedule up to 200 e-mail alerts on Companies of his choice.

The second level is the Premium Member. This access is fee-based. It provides a service above and beyond the NetWorker services. It includes scheduling of targeted alerts by roles, countries or industries, contacting listed Executives by e-mail through our platform and downloading files by Company.

Some Executives may be unreachable because we have not yet obtained or confirmed a valid business e-mail, or the Executives may have opted not to receive e-mails. This is indicated in their Executive Information.

The Executive’s email is not communicated by the Editor to the Member. Only the Executive, upon receiving the Member’s email, decides to provide the Member his email. The Member email is indicated to the receiving Executive for him to decide to answer directly rather than through our email platform.

The third level is the VIP Member. This access also is fee-based. It affords access to an even broader service than the premium service. It also includes the option to receive lists of executives in CSV/Excel and to obtain assistance by email.

The subscription fees (Fees) are based on the purchased Service and not on actual usage. The Fees cannot be cancelled or refunded except during the first 30 days of the first subscription and when expressly stated.

Each Member can opt in or opt out in “My Account” for an automatic subscription renewal. The Member has to do this at least 24 hours before the end of the current period.

In order to avoid any interruption of service, the account will be charged for the renewal fee within 24 hours prior to the end of the current period. The renewal Fee amount will be at the best current cost for the same duration of the current subscription.

When a Fee-based subscription ends, the Member will keep the benefits of Free NetWorker service and the remaining Talers.

 

Validation of Information provided by a Site Member

Each Information or piece of Information (Company Information or Executive Information) presented by a Member (the Contributor) must be certified as accurate by the Contributor.

Following receipt of this information, the Site validates the accuracy of the submitted information. If the information submitted cannot be verified as accurate, the Member is asked to certify again the Information he has submitted. If the Member does not certify it within the 72 hours of this request, the information will be considered inaccurate.

If the Site considers the Executive Information as accurate and has a valid business email of the Executive whose listing is being updated, the Site will ask the Executive for validation of the information submitted.

1 / If the Executive confirms the information within 72 hours, the information will be considered correct and published along with its publication date.

2 / If the Executive challenges the accuracy of the information within 72 hours, the Site asks for a confirmation or denial from the Contributor of the information’s accuracy.

2a/ In event of a failure to confirm the information by the Contributor or in case no response from the Contributor is received within 72 hours, the Information provided by the Contributor will be considered inaccurate.

2b/ In event the information from the Contributor is confirmed, and if the Site is able to carry out further validations of it as correct, the Information will be published.

2c/ In event the information from the Contributor is confirmed, and if the Site cannot carry out further validation of it, the Information from the Contributor will be considered neither correct nor incorrect and will not be published.

3/ If the Executive cannot be reached by email, or if the Executive does not respond within 72 hours, or if the Information pertains to a Company, the information will be considered as correct and published.

If the Information has not been disputed seven days after being posted, the Contributor will be fully credited regardless of any future disputes over the information’s accuracy.

For each known Member, the Site may provide a reliability index of the Member's contributions. This index is calculated by his accurate and confirmed contributions minus its incorrect contributions divided by its total number of contributions over the preceding 12 months. If this reliability index does not remain above 80 percent, the Member Account could be cancelled without compensation or reimbursement.

 

Correct information and Incorrect information

All contributions must be certified by a Site Member to be deemed correct. However, because some details of the Member’s contributions may be inaccurate, if information is considered incorrect by a third party, the Site will notify the Contributor so that he can challenge the decision of the Site.

Incorrect information can be a name that is either misspelled or wrong (example: John vs. Jones, Maria vs. Jack), a reporting line which is erroneous (example: Peter reports to the President and not by the Sales Director), or a personal email address instead of a business e-mail ([email protected] vs. [email protected]). Updating such information will earn Talers for its author.

Information is not considered incorrect if an abbreviation has been used on a title (VP Marketing, for example, vs. Vice President Marketing), a name (example: John D. vs. John, or Bob vs. Robert). Updating such information will bring a credit of one Taler to its author.

In case of confusion, The Site maintains the right of the final decision and the decision will not result in any compensation.

 

The rights and duties of the App Users

An App User (App User) is an individual who has downloaded the App on his mobile phone and fully accepted its Terms of Use. This acceptance entitles him to access the Services. Each App User certifies that he is a capable adult of 18 years of age or older.

Each App User can close his account at any times. Such closure will not entitle the User to any compensation or reimbursement. 

Each App User undertakes to use the App with professional responsibility, respecting the privacy and rights of everyone. Any App User who does not comply with the conditions and Terms of Use, agrees to be immediately removed without compensation or reimbursement.

 

Two levels of Service for App Users

There are two levels of Services for App Users: Free and Pro.

The first level is the Free Version. Access to this is free. It allows the App User to view our 5,000 most popular corporate organizational charts with executive information, and to schedule up to 10 alerts from the 5,000 companies listed.

The second level is the Pro Version. Access to this is by fee-based subscription. It provides a broader service beyond the Free service, including the ability to view and search all our corporate organizational charts (over 60,000), the Executive Information for these respective corporations, and to schedule e-mail alerts on up to 200 Companies.

Subscription payment will be charged at confirmation of purchase. These subscription fees are not refundable.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours prior to the end of the current subscription period. Accounts will be charged for renewal at the best current cost within 24 hours prior to the end of the current period. Subscriptions may be managed by the User and auto-renewal may be turned off by going to the User’s account settings after purchase. 

When the fee-based subscription ends, the App User will continue to be able to utilize the Free Version.


The rights and responsibilities of the Executives

The Editor makes its best efforts to verify every new Executive Information collected on dependable, publicly-available business sources.

The Editor then makes its best efforts to promptly check the new Executive Information with the Executive on its Company e-mail address.

The Executive Content or the Company Content can be verified, adjusted, confirmed, or deleted by the Executive.

The Editor will promptly post any changes, additions or deletions proposed by the Executive about the Executive Content provided it is not misleading or incorrect.

When the Editor has a valid Executive e-mail, the Editor will encourage the Executive to become a NetWorker Member (free access) with preferential services including a priority process to check and update his respective content.

 

Privacy

The Editor is committed to respecting and protecting your privacy. Your personal data including your e-mail address will not be sold, rented, traded or posted, except if required by Law.

Your acceptance of the Terms of Use includes your full acceptance of the collection of the use of your personal data as detailed in the Privacy Policy

 

Disclaimer

Despite the care provided by the Editor for moderating and updating content, content may contain errors or omissions, which you acknowledge and agree. You agree to use the Service "as it is" and any liability of any kind cannot be sought under this heading against the Editor, its officers, its employees, or its agents. The Editor, its officers, employees or agents may under no circumstances be held liable for the inability to use or to access the Service.

 

Intellectual property

The Content is an intellectual property on which the Editor holds exclusive rights of reproduction, representation, distribution and exploitation.

 

Brands

The Official Board is a registered trademark. Any use of this trademark or of the other trademarks and intellectual property titles mentioned in the Service, or on this Site are expressly excluded from this license and formally forbidden.

 

Applicable law and disputes

In case of dispute, only French law applies and Nanterre (France) courts have the exclusive jurisdiction, even if in warranty or multiple defendants. In case of conflict between the various language versions of the Term of Use, the French version will prevail.
